This Policy applies as between you, the User of this Web Site and us, Morphy Richards, the owner and provider of this Web Site. This Policy applies to all Data collected by us during the course of and in relation to your use of the Web Site (and any Services or Systems). By using the Web Site you are deemed to have accepted the terms of this Policy.

This allows us to identify recurring visitors and to analyse their browsing habits within the Web Site. Where e-commerce facilities are provided, Cookies may be used to store your shopping basket;

“Data” means collectively all information that you submit to the Web Site including but not limited to personal information, payment information and other information submitted when using any of our Services or Systems;

“Morphy Richards” means Morphy Richards Limited (company number 644702) whose registered office is at Talbot Road, Mexborough, South Yorkshire, S64 8AJ;

“Service” means collectively any online facilities, tools, services or information that Morphy Richards makes available through the Web Site either now or in the future;

“System” means any online communications infrastructure that Morphy Richards makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

“User” / “Users” means any third party that accesses the Web Site and is not employed by Morphy Richards and acting in the course of their employment; and

“Web Site” means the website that you are currently using (www.morphyrichards.co.uk, www.momentocoffee.com and www.homeofthehouseproud.com) and any sub-domains of this site, unless expressly excluded by their own terms and conditions.

2. Data Collected

Without limitation, any of the following Data may be collected:

2.1 name;

2.2 email address;

2.3 contact information such as postal addresses and telephone numbers;

2.4 demographic information such as post code, preferences and interests;

2.5 financial information such as credit / debit card numbers;

2.6 IP address (automatically collected);

2.7 web browser type and version (automatically collected);

2.8 operating system (automatically collected);

2.9 a list of URLS starting with a referring site, your activity on this Web Site, and the site you exit to (automatically collected); and

2.10 Cookie information (see clause 12 below).

3. Our Use of Data

3.1 Any personal Data you submit will be retained by Morphy Richards for as long as you use the Services and Systems provided on the Web Site. Data that you may submit through any communications system that we may provide may be retained for a longer period of up to 12 months.

3.2 All personal Data is stored securely in accordance with the principles of the Data Protection Act 1998 (the “Act”). For the purpose of the Act the data controller is Morphy Richards. For more details on security, see clause 11 below.

3.3 Any or all of the above Data may be required by us from time to time in order to provide you with the best possible service and experience when using our Web Site. Specifically, Data may be used by us for the following reasons:

3.3.1 internal record keeping;

3.3.2 improvement of our products / services;

3.3.3 subject to paragraph 4 of this Privacy Policy, transmission by email of promotional materials relating to products / services that may be of interest to you;

3.3.4 contact for market research purposes which may be done using telephone, fax or mail. You may opt out of being contacted in this way at any time. Such information may be used to customise or update the Web Site.

4. Emails

4.1 If you are an existing customer, we will only contact you by email with information about products and services similar to those which were the subject of a previous sale to you. You may opt out of receiving this information at any time by following the instructions on the email.

4.2 We will not otherwise email you unless (a) you have specifically given your consent in response to “opt-in” boxes etc or (b) in response to your emails to us. We will not pass on your email address to any third parties unless you have specifically consented to this.

5. Disclosure of Data

5.1 The information you provide to us will be held on our computers in the United Kingdom and accessed by or given to our staff working within the United Kingdom.

5.2 We may share aggregate information with our group companies and other parties within the United Kingdom. This is statistical data about Users’ browsing actions and patterns and does not identify any individuals. We will not (save as set out in this Policy) sell, transfer or share any personal information about you as an individual User of the Web Site outside our group of companies.

5.3 Where you have explicitly consented by way of “opt-in” when providing us with your personal details, we may also allow carefully selected third parties, including other companies in our group, to contact you occasionally about other products and services which may be of interest to you. They may contact you by telephone, fax or mail. You may opt out of receiving this information at any time.

You authorise us to disclose any information about you to such law enforcement or other government officials as we, in our sole discretion, believe necessary in connection with the investigation of fraud or other activity that is illegal or may expose us or you to legal liability. You further authorise us to process your information, including sensitive personal information, where the processing is necessary for the purpose of legal proceedings, obtaining legal advice, establishing or defending legal rights or for the administration of justice or the exercise of functions of a public nature.

6. Third Party Web Sites and Services

Morphy Richards may, from time to time, employ the services of other parties to deal with matters that may include, but are not limited to, payment handling, delivery of purchased items, search engine facilities, advertising and marketing. The providers of such services do not have access to certain personal Data provided by Users. Any Data used by such parties is used only to the extent required by them to perform the services that Morphy Richards requests. Any use for other purposes is strictly prohibited. Furthermore, any Data that is processed by third parties must be processed within the terms of this Policy and in accordance with the Act.

7. Changes of Business Ownership and Control

7.1 Morphy Richards may, from time to time, expand or reduce its business and this may involve the sale of certain divisions or the transfer of control of certain divisions to other parties. Data provided by Users will, where it is relevant to any division so transferred, be transferred along with that division and the new owner or newly controlling party will, under the terms of this Policy, be permitted to use the Data for the purposes for which it was supplied by you.

7.2 In the event that any Data submitted by Users will be transferred in such a manner, you will not be contacted in advance and informed of the changes.

8. Controlling Access to your Data

Wherever you are required to submit Data, you will be given options to restrict our use of that Data. This may include the following:

8.1.1 use of Data for direct marketing purposes; and

8.1.2 sharing Data with third parties.

9. Your Right to Withhold Information

9.1 You may access certain areas of the Web Site without providing any Data at all. However, to use some Services and Systems available on the Web Site you may be required to submit Data.

10.1 You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact us.

10.2 You have the right to ask for a copy of your personal Data on payment of a small fee.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your Data, we cannot guarantee the security of Data transmitted to the Web Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to safeguard the Data and prevent unauthorised access.

12.3.1 Cookies to help the use of your site. These do things such as helping you to place comments on this site. If you restrict or reject your use of these cookies you will find that your use of this website may be hindered.

12.3.2 Third party cookies – The main third party cookies that Morphy Richards use are one that track the use of this website. Morphy Richards uses Google Analytics, supplied by Google Inc, to report on activity on this website. These cookies can only identify that someone has used the site and do not collect any personal data. During your visit there may be cookies used that are not related to this website. These could be placed if you view images or video via YouTube or Flickr that are embedded in a page. Morphy Richards reserves the right to change this Policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Web Site and you are deemed to have accepted the amended terms of the Policy on your first use of the Web Site following any such alterations.

Homemade Cook of the Year Competition – Terms and Conditions

The Promoter

The Promoter is Morphy Richards Limited, Adwick Park, Manvers, Rotherham, South Yorkshire S63 5AB, (CRN: 0644702).  All queries regarding this competition must be directed only to the Promoter and must be marked “Homemade Cook of the Year Competition, Marketing Department”.

BY ENTERING THIS COMPETITION YOU AGREE TO PARTICIPATE IN REASONABLE AND RELATED PUBLICITY AND AGREE THAT THE PROMOTER OR ITS AGENTS/SUBCONTRACTORS MAY USE YOUR EMAIL ADDRESS TO SEND YOU PROMOTIONAL MATERIALS RELATING TO PRODUCTS AND SERVICES THAT MAY BE OF INTEREST TO YOUIF YOU DO NOT WISH TO RECEIVE PROMOTIONAL MATERIALS RELATING TO PRODUCTS OR SERVICES WHICH MAY BE OF INTEREST TO YOU, PLEASE SPECIFY THIS ON YOUR ENTRY

Eligibility

This competition is open to all UK residents aged 18 or over, except for employees of the Promoter and any of such employees’ families or members of the same household, or any marketing services agency, handling house, or other company involved in the competition.  No purchase is necessary.

To Enter

To enter the competition through Morphy Richards* directly, either:

1) Go to www.homeofthehouseproud.com/category/home-made-cook-of-the-year and upload your recipe and photograph of the dish in the format suggested. Remember to state where you heard about the competition (which partner)

2) Email your recipe and photograph to homemadecookoftheyear@finncomms.com; or

3) Send your recipe and photograph in the post to Homemade Cook of the Year Competition, Finn Communications, Round Foundry Media Centre, Leeds LS11 5QP

All entries should include your name, addresses, email address and contact telephone number.  The deadline for entries is midday on 20/11/2011. Any entries received after this date will not be included in the competition and will be void.

You may enter multiple recipes providing that you do not enter a recipe, or very similar recipe, more than once. Any recipe that has been entered previously will be void.  Recipes uploaded should be your own creation or an adapted version of a published recipe, due to copyright restrictions, recipes will not be accepted which have been published (see below ‘Conditions’ for further details).

To enter the competition indirectly:

1.  Through WI send your recipe and photograph in the post to Homemade Cook of the Year Competition, Denman College, Marcham, Abbindgon, Oxfordshire, OX13 6NW

2.  Through Diabetes UK send your recipe and photograph in the post to Homemade Cook of the Year Competition, Finn Communications, Round Foundry Media Centre, Leeds LS11 5QP

3.  Upload your recipe and photograph to Delia Online

*If you have entered the ‘Homemade Cook of the Year’ competition through one of Morphy Richards’ partners (The Women’s Institute, Delia Online or Diabetes UK), please refer to the individual partners terms and conditions.

Validity

By submitting your entry you will agree to be bound by these Terms & Conditions.  Entries through agents or third parties (other than Morphy Richards partners stated above) will be invalid.  Entries not submitted in accordance with these rules or incomplete or illegible entries will be disqualified.  Responsibility cannot be accepted by the Promoter for lost, undelivered, delayed, damaged or mislaid entries.  Please retain a copy of these Terms and Conditions for your reference.

Conditions

In entering the competition you confirm that the entry 1) is your original work; 2) does not infringe the intellectual property or privacy rights of any third party; 3) has not been entered into, or won, any other competition or award; and 4) has not been published previously in any medium. If you are selected as a finalist you must be able to attend a ‘cook off’ event at Denman College on 5 December 2011

You also confirm that 1) you assign all rights in your entry to the Promoter and its affiliates, legal representatives, assigns and agents to use in any media throughout the world and for any purpose without limitation 2) you waive all intellectual property and other rights in the entry and will not pursue any claim against the Promoter for use of your entry in any way; 3) you agree to indemnify and hold the Promoter and its respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees harmless from any and all claims, damages, expenses, costs (including reasonable legal fees) and liabilities (including settlements), brought or asserted by any third party due to or arising out of your entry, the Promoter’s use thereof, or your conduct during and in connection with this competition, including but not limited to any and all claims damages, expenses, costs (including reasonable legal fees) and liabilities (including settlements) relating to infringement of a third party’s trade mark, copyright, or other intellectual property rights, infringement of a third party’s right of publicity, infringement of a third party’s right of privacy or defamation.

To Win

  1. There are four ways of entering the ‘Homemade Cook of the Year’ competition, through either the Women’s Institute, Delia Online, Diabetes UK or Morphy Richards’ ‘Home of the House Proud’ portal. These terms and conditions cover entries that are made directly through Morphy Richards’ ‘Home of the House Proud’ portal. If you’re entering through a partner, please refer to their terms and conditions
  2. Send us a recipe for your favourite home cooked main meal along with a photograph of the dish via one of the methods listed under ‘To Enter’ section above
  3. The meal must cost £7.50 or under and be able to feed a family of four.  Although the main meal must cost less than £7.50, ingredients such as salt and pepper (‘seasoning’) don’t have to be included within this cost
  4. A winner (finalist) and three runners up from each partner (Women’s Institute, Delia Online, Diabetes UK) will be selected based on criteria of meal cost, nutrition and flavour.  Entries will be judged by a judging panel. The judging panel’s decision is final.
  5. Each of the first placed winners will be invited to attend a ‘cook off’ event at Denman College on 5 December 2011
  6. Finalists will cook their entered recipe in the Denman College Cooking School.  All food ingredients will be provided to the winners at Morphy Richards’ cost.
  7. The overall ‘Homemade Cook of the Year’ will be chosen based on the cost effectiveness, nutritional value and flavour of their meal.  The winner will be chosen after the ‘cook off’ by Brian Turner and his decision will be final

The Prize

The ‘Home Made Cook of Year’ (Overall Winner) will win a Morphy Richards kitchen makeover to the value of £1000 (exclusive of VAT) including a Stoves Mini Range and a selection of Morphy Richards cooking products.  The winner will also receive, a Roberts DAB radio and a one day Women’s Institute cooking course for them and a friend.

Two finals runners up will each win a Morphy Richards cooking product of their choice up to a recommended retail price of £150, a Roberts DAB radio and a one day Women’s Institute cooking course for them and a friend.

Nine partner runners up will each win a Morphy Richards cooking product of their choice up to a recommended retail price of £150, a Roberts DAB radio and a one day Women’s Institute cooking course for them and a friend.

Each entrant will receive a single use 15% discount code for purchase of any Morphy Richards Worktop Cooking product direct from Morphy Richards.

Notification

The winners will be notified by the Promoter by telephone or email within 7 days of the closing date.  Winners must reply to the Promoter within 48 hours of notification in order to claim their prize.  Any unclaimed prizes will be awarded to a reserve winner.  If you wish to find out the winners, please send a stamped addressed envelope to Homemade Cook of the Year Competition, Finn Communications, Round Foundry Media Centre, Leeds LS11 5QP after 31 January 2011.

Winner Publicity

The Promoter shall have the right to use your name, age, town of residence and likeness, for the purposes of announcing the winners of this competition and for related promotional purposes.  You may also be required to take part in post competition publicity.

Alteration Amendment or Withdrawal

In the case of unforeseen circumstances, the Promoter reserves the right to alter, amend or withdraw the competition without prior notice.

Your Personal Data

Any personal data relating to entrants will be used solely in accordance with current UK data protection rules and regulations.  If you do not wish to receive promotional materials relating to products or services which may be of interest to you, please specify this on your entry.  The Promoter reserves the right to disclose the identity of an entrant and/or the IP address used to upload an entry where a third party claims there has been a violation of their intellectual property or other rights.

The Promoter accepts no responsibility for any injuries incurred in the making and submitting of any entry.
